学生申诉制度是《教育法》确立的保障学生合法权益的重要制度,教育部2005年3月出台的新《普通高等学校学生管理规定》将这一制度进一步明确和细化。尽管如此,高校学生申诉制度仍然存在很多问题。为完善高校学生申诉制度,笔者提出对策:公开选举“学申委”的组成人员,确保其在校内的独立身份;“学申委”的受理范围扩大到学生在校学习生活等各方面权利受损的情况;明确授权“学申委”对学校处分具有“有限变更权”;在相关教育法律、法规中增设“学生申诉处理委员会逾期未对申诉人的申诉作出复查结论,以及学校不履行学生申诉处理委员会和省级教育行政部门作出复查决定的,应承担相应法律责任”等条款。 相似文献
