SUMMARY

Digital technology and global economic trends present fundamental challenges to copyright law in the twenty-first century. On a practical level, librarians need to understand the particulars of current laws in order to make responsible decisions and to utilize to the fullest extent the possibilities that copyright law affords them in their missions. This article will identify the major copyright issues associated with library digital activities, and will discuss copyright protection in the digital environment of material originating in the Slavic, East European, and Eurasian nations. It covers use of Slavic and East European material in the U.S. in various contexts, including Internet activity, preservation and replacement, interlibrary loan, electronic reserves, classroom and educational use, text encoding, digitization of print and microform materials, and creation of digital content and databases.  相似文献

ABSTRACT

Catalogers of monographs are accustomed to finding a publication, copyright or at least a printing date in an imprint on the title page or in a colophon. If no date is found in the “prescribed sources of information,” rule 1.4F7 of AACR2 instructs catalogers to “supply an approximate date of publication.” This article examines efficient ways of doing this, using examples from German publishing. In the 19th and early 20th centuries, German publishers often omitted the year of publication from their imprints. Also discussed are standard bibliographic sources where estimated publication dates can often be confirmed. The methods and examples presented are drawn from cataloging experience at Texas A&M University since 1992, when the library purchased several thousand German books of this period.  相似文献

Abstract

This guide offers extensive resources on the intersection of intellectual property law and contemporary visual art and on the application of the doctrine of fair use within this context. It is designed to assist attorneys, museum administrators, art collectors, art dealers and artists in handling litigation involving copyright litigation. It is particularly focused on copyright claims arising out of the art movement known as “appropriation,” which has emerged as a litigation target due to its use of familiar images and image genres drawn from public and consumer media. The guide strives to aid artworlders and attorneys new to art litigation in developing an understanding of the limitations and extent of fair use protections for visual artwork.  相似文献

SUMMARY

In this study, a group of recent law articles was examined to determine the proportion of cited resources that are easily findable online. Searches were conducted in databases such as LEXIS and Westlaw, and on the Internet, for full-text versions of every source cited in seven articles. The results have been broken down into 13 categories, including “federal cases,” “books,” “foreign law,” and “legal periodicals pre-1990.” Not surprisingly, coverage differs widely between the categories. Overall, the study found that 77% of the 1,984 citations in the articles reviewed are available online. The article concludes with a general discussion of why the percentage is likely to increase in the future.  相似文献

Concepts from Heider's “Attribution of Responsibility” theory were used to investigate the process of message source evaluation. The results of a role‐playing experiment indicate that: (1) When a message source's previous behavior has had favorable consequences for a receiver, the source will be rated more “safe,” “qualified,” and “dynamic” to the extent that responsibility for those consequences are attributed to the source; and (2) when the source's previous behavior has had unfavorable consequences for the receiver, the source will be judged less “safe” but more “qualified” and “dynamic” to the extent that responsibility for those consequences are attributed to the source.  相似文献

ABSTRACT

Expanded Collection was an analog version of a “virtual” collection that relied on the Document Delivery Department and vendor intervention to obtain materials. Developed to offset budget cuts, it was a list of 205 periodical titles that were cut from the collection but remained listed in the library catalog. Although initially successful, it became difficult to administer. Court interpretations of copyright law caused the Document Delivery Department to rely on standard interlibrary loan procedures and raised ethical questions about Expanded Collection. Improved efficiency in the interlibrary loan process and the increased access to electronic journals made Expanded Collection obsolete.  相似文献

When radio and television are touted as the “greatest media for education” or the “promoting of social change” that the world has ever known, the need of the developing countries of the world for these media is often cited. It is probable that most citizens of the United States think of “developing nations” as those newly‐formed countries of Asia and Africa whose political, social and economic problems often are featured in the day's news reports. However, there are more than a score of developing nations in the western hemisphere, and one of these is right at the back door of the U. S. This country, Mexico, has been using radio and television effectively for a major literacy program since 1965, and the following article describes that program. Dennis Lowry is a doctoral candidate in mass communication in the University of Minnesota School of Journalism and Mass Communication. Abstract

Colorado State University-Pueblo, Interlibrary Loan Department has used Clio software for nearly seven years on a variety of network and client operating systems. The department has integrated Clio functions with WebZap and WebView electronic request and article delivery software, as well as the request features offered through OCLC's FirstSearch databases. An ongoing project is the interoperability of Clio-Request with the ILL request forms offered by the Ebsco databases. Originally purchased to automate copyright claiming, Clio has more than proven its flexibility and usefulness over the years.  相似文献

This article reports on the results of a national survey of academic librarians and library staff (N = 226) in the United States about their awareness of various copyright policies, partnerships with campus groups to address copyright issues, and training needs. A majority of the survey respondents reported that they have answered copyright-related questions in the workplace, yet only 49% (n = 98) of the respondents perceived they were prepared to provide copyright information to library users. Awareness of various copyright policies among librarians and staff members varied, including a reported minimal awareness of the T.E.A.C.H. Act. In addition, survey respondents expressed the desire for more copyright-related training. In light of these findings, the present study extends the existing literature and offers recommendations to help better prepare a “copyright confident” or “copyright responsive” academic library workforce.  相似文献

Ideas for promoting electronic reserves to faculty on a university campus are presented in this paper. Also included is a convenient handout that the library distributes to faculty or discusses at presentations or workshops. The “difficult” requests submitted by the research library users prove document delivery vendors could hardly replace interlibrary loan librarians. “Difficult” requests ask for the “grey literature” not traded commercially and not kept in libraries. They require the special attention and professional knowledge of the interlibrary loan librarian. Besides usual bibliographic and reference tools, the Internet, e-mail, and the search engines have to be employed to solve them. The help of those responsible for the production of the literature in question is significant. In tackling “difficult” requests, interlibrary loan librarians may further add value to their services by facilitating sharing between scholars or researchers. Five actual cases are presented to illustrate how the “difficult” requests were tackled and solved.  相似文献

Abstract

This concept was initially developed by William Wilson, library consultant, PROVIDENCE Associates Inc. It was modified for a presentation at die 1996 Texas State Library Association Convention. It outlines a different way of thinking about funding libraries, an innovative framework that will interest legislators in the plight of their under-funded library services. Wilson and Waters refer to this new structure as a “Library Authority.” The concept would allow the question of funding to go directly to the voters, who are those most concerned with the quality of libraries. This quality is also addressed by Waters, who considers quantity and volume as a faulty line of reasoning for gathering support. “We make little mention of the long-term impact associated with introducing a four-year old to the world of books… or to the economic impact derived from helping a saleswoman locate a new market for her products.” Mr. Waters hopes others will assist in fleshing out this concept for the good of all libraries.  相似文献

Since the year 2001, Kenya’s copyright regime has extensively been shaped by Trade-Related Aspects of Intellectual Property Rights (TRIPS) agreement; World Intellectual Property Organization Copyright Treaty; Africa Growth Opportunity Act (AGOA); and The Cotonou Agreement, which have advocated for effective copyright administration and management structures in addition to stiffer penalties for those who violate copyright laws. Despite better administrative structures being put in place, copyright infringement in Kenya has persisted. Being able to balance the needs of rights owners and information consumers becomes a critical role librarians have to play. Knowledge about copyright, thus, becomes critical. Despite the fact that librarians in Kenya are not a homogenous group, how knowledgeable the different librarian cadres are concerning copyright issues is least understood. The raison d’être for this study is to find out whether different cadres of librarians based on academic qualifications differ in the level of knowledge on copyright issues. A questionnaire was used to collect data. Results indicate no statistically significant difference in self-reported knowledge of copyright among the five librarian cadres based on their education level and neither is there a statistically significant difference based on librarians’ years of service. Statistically significant differences among the five librarian cadres exist when we compare “tested knowledge” of copyright issues. Evidence of insufficient mastery of provisions in the Kenyan copyright law does exist.  相似文献

Social media have changed the way we create, share, and experience visual media. Such collaborative exchanges defy traditional notions of ownership and do not conform to copyright's view of the image as a singularly “fixed” construct. In mobile contexts especially, images are dialogic, conveying far more complicated messages than ever before. This article relies on an examination of theories of the image to inform discussions about copyright reform in the digital age. It briefly explores visual culture theory and the status of visual media in copyright law, and it offers suggestions for how copyright law might adapt to encourage online visual expression, creativity, and economic gain.  相似文献

ABSTRACT

Copyright and special collections share an intimate relationship gone awry. This article explores copyright principles, their underpinnings and origins in the United States, and contemporary applications of them. The contemporary limits impose unreasonable barriers to the widespread sharing of special collections and reflect unnecessarily broad protections of and limits on an enormous range of creative works regardless of the social consequences of that protection or any demonstrable inherent or remaining economic value in those works. Copyright interpretation requires highly fact specific analysis. For many special collections, much of that factual predicate has simply drifted from the historical record.  相似文献
