行政诉讼的原告资格问题是关系到能否启动行政诉讼的首要问题,所以正确界定和掌握行政诉讼原告资格的认定标准有着重要的现实意义。我国对行政诉讼原告资格的认定标准正逐步向宽松方向发展,本文从行政诉讼原告资格的涵义入手,通过对《行政诉讼法》及最高人民法院《关于执行〈中华人民共和国行政诉讼法〉若干问题的解释》中对原告资格的规定进行分析,得出了目前我国认定行政诉讼原告资格的几点标准,并进行了相应分析。 相似文献

在20世纪90年代我国社会发生重大变迁而行政诉讼法未能及时修正的背景下，最高人民法院探索性地颁行了新司法解释，对我国行政诉讼原告资格进行重新界定，但其历史局限性也是明显的。新司法解释的属人因素及属事因素上都对行政诉讼原告资格作出了限制性规定，有些规定甚至是对行政诉讼法的倒退。为使我国行政诉讼原告资格继续向逐步放宽的世界性趋势发展，最高人民法院及其司法解释仍任重道远。 相似文献

行政诉讼是以行政行为为诉讼标的的,给因行政行为的行使而受到侵害的行政相对人以救济的诉讼活动。而被告是行政诉讼的必要条件,只有对其加以正确认定,才能更好地保护相对人的合法权益。目前,我国行政诉讼被告资格的确定是以行政主体为标准的。但是,这一认定标准给司法实践带来许多困难,导致行政相对人的合法权益不能得以及时、有效的保护。作为行政诉讼被告资格确定的理论依据——行政主体理论,是从国外引进的,但该理论在我国只有其名而无其实,以行政主体作为确立行政诉讼被告资格的标准已突显许多缺陷。因此,我国应当根据国情、借鉴国外成功的经验,确立以便于诉讼为主要目的的行政诉讼被告资格确认标准。 相似文献
