An extended treatment of Out Of Print, a documentary film by Vivienne Roumani that debuted at 2013 TriBeCa Film Festival January 2014 in New York. The success of the self-published The Mill River Recluse vis-à-vis the lack of success of most self-published titles is also discussed, as are the future of libraries and education in general. EU law currently distinguishes ‘physically embodied’ books and e-books for value added tax purposes, even where their content is the same. This article explores the legal root of that difference and, employing the principle of ‘fiscal neutrality’ (a subset of equal treatment) it aims to shed light on the current cases pending before the Court of Justice of the EU against France and Luxembourg for their unilateral reductions in e-book rates. The last part of this article looks at another area of physical and e-book divergence, first sale, and considers what an equality based approach could have to say about this.  相似文献

Inquiries into allegations of human rights abuses require a reliable corpus of evidence to proceed and hold violators accountable for their actions. The following article analyzes the 2005 police shootings that occurred on New Orleans’ Danziger Bridge in the wake of Hurricane Katrina, a case that illustrates the challenges confronting investigations into human rights violations in the USA. By examining an investigative police report, two survivors’ civil complaints, and federal court filings, the article argues that the methodical nature in which several police officers in post-Katrina New Orleans conspired to document the use of deadly force against several unarmed citizens demonstrates that police records created in the context of officer-involved shootings inhibit accountability processes as much as they facilitate them. The deliberate creation of such records, the article concludes, impairs the ability of a democratic nation to ensure human rights and bring their violators to account.  相似文献

The International Criminal Tribunal for the former Yugoslavia (ICTY) will complete its proceedings over the coming years, leaving behind an enormous collection of records. The ICTY archive provides a record of conviction and acquittal, prosecution case, and defense response—a vast series of contested facts and arguments. The ICTY winds down with a decidedly mixed reputation, especially among the communities of the Balkans, doing damage to the already-discredited idea of a Tribunal capable of aiding the processes of reconciliation. And yet the UN still speaks of the reconciliatory purposes the ICTY archives may serve. Pursuing reconciliation, however, sets up the archives for failure. It would be better for those establishing the archives to focus on other, attainable goals, taking into account Minow’s caution against judicial records that merely ‘speak for themselves.’ This essay provides historical context for the development of the ICTY archives, outlining its two decades of work, and emphasizes the political context from and into which the archives will emerge.  相似文献

How do distinctive historical experiences and political regimes shape human rights archives? How do those archives and those experiences in turn influence the way painful pasts are remembered or forgotten? And what can historical accounts tell us about the wisdom of prevailing norms and practices regarding the management and control of human rights records? This paper explores these questions through a close analysis of the history and politics of the principal archive documenting human rights abuse in East Timor. It underscores the work of archival studies scholars who argue that human rights archives are always in some degree shaped by the historical and political context in which they emerge and that conflicts over matters of content, mandate, and rules of access are virtually inevitable. Noting that such conflicts typically pit political authorities against victims and their advocates, it argues that successful human rights archival programs hinge critically on sensitive historical and political analysis and that, under certain conditions, human rights archivists should play a more active role in facilitating the pursuit of justice for victims of human rights abuse. It also makes the case for a move away from large, state-controlled archives toward multiple, smaller archives with varied mandates. Finally, it proposes the adoption of a new hierarchy of interest in the management of archives; away from the long-accepted principles of national sovereignty and inalienability, and in the direction of access to the survivors of human rights violations and their advocates.  相似文献

The purpose of this investigation is to apply Gold's (1989 Gold, D. T. (1989). Sibling relationships in old age: A typology. International Journal of Aging and Human Development, 28, 3751.[Crossref], [PubMed], [Web of Science ®] [Google Scholar]) typology of sibling relationships to the study of adult-sibling use of relational maintenance behaviors and perceptions of relational characteristics. Participants were 196 adults who targeted a sibling whose birthday was closest to their own and completed a series of instruments in reference to the targeted sibling. It was found that whether individuals classified their sibling relationships as intimate, congenial, loyal, or apathetic/hostile was reflected in their self-reported use of relational maintenance behaviors, their perceptions of their targeted siblings' use of relational maintenance behaviors with them, and their perceptions of the relational characteristics associated with the sibling relationship.  相似文献

Weiner's (2000 Weiner , B. ( 2000 ). Intrapersonal and interpersonal theories of motivation from an attributional perspective . Educational Psychology Review , 12 , 114 . [CSA] [CROSSREF] [Crossref], [Web of Science ®] [Google Scholar]) attributional model of intrapersonal motivations suggests that attributions influence not only people's emotional experiences, but also their behavioral responses to the events that caused these emotions. The current study investigates the causal dimensions (i.e., stability, controllability, locus) of five emotions (i.e., sadness, helplessness, hurt, fear, anger) people commonly experience when they are distressed and in need of emotional support. Participants (N = 258) were asked to identify an upsetting event and subsequently talk about it with a confederate helper in a five-minute conversation. After the conversation, participants completed attribution and emotion indices scales. The events discussed were coded into nine categories (e.g., death of a relative, college performance/job problems, break-ups). Results suggested that the five emotions possess a unique attributional make-up and are uniquely tied to specific events that were discussed by participants. Implications of the results are discussed in the context of providing emotional support to people who experience distress.  相似文献

Bibliometric data indexed through the Institute for Scientific Information were analyzed for 45 communication journals. Several measures were included to identify the most widely cited journals in the field, including (a) journal impact factor, (b) five-year journal impact, (c) article influence, and (d) journal relatedness. Results serve to expand on findings by Feeley (2008 Feeley , T. H. ( 2008 ). A bibliometric analysis of communication journals from 2002 to 2005 . Human Communication Research , 34 , 505520 .[Crossref], [Web of Science ®] [Google Scholar]) with respect to overall and within-field influence of communication journals whose analysis covered 2002 through 2005 and 19 journals. More than 60% of college students admit to trying smoking (Rigotti, Lee, & Wechsler, 2000 Rigotti , N. , Lee , J. E. , & Wechsler , H. ( 2000 ). To reduce this number, researchers have attempted to determine factors influencing smoking behaviors. However, studies about communicative acts related to smoking intentions and behaviors, which may be factors, are lacking. Guided by the Theory of Planned Behavior, this study hypothesized that attitudes, subjective norms, and perceived behavioral control regarding communicating about smoking would be positively associated with behavioral intentions to engage in such communication. It was found that students' attitudes toward communicating about smoking were positively associated with behavioral intention, but perceived behavioral control and subjective norms concerning smoking-related communication behaviors were not associated with behavioral intention.  相似文献

Teaching in an online environment is not without its barriers. Time for course preparation, a need to engage students, and the need for near-constant accessibility make teaching online more difficult than might be the case in a face-to-face environment. However, changes in society, the need for students to interweave scholarship with their lives, work, and families, and continuing competition among higher education institutions are some reasons to do so. Objective

The research determined the usage and satisfaction levels with one of two point-of-care (PoC) resources among health care providers in a rural state.

Methods

In this randomized controlled trial, twenty-eight health care providers in rural areas were stratified by occupation and region, then randomized into either the DynaMed or the AccessMedicine study arm. Study participants were physicians, physician assistants, and nurses. A pre- and post-study survey measured participants'' attitudes toward different information resources and their information-seeking activities. Medical student investigators provided training and technical support for participants. Data analyses consisted of analysis of variance (ANOVA), paired t tests, and Cohen''s d statistic to compare pre- and post-study effects sizes.

Results

Participants in both the DynaMed and the AccessMedicine arms of the study reported increased satisfaction with their respective PoC resource, as expected. Participants in both arms also reported that they saved time in finding needed information. At baseline, both arms reported too little information available, which increased to “about right amounts of information” at the completion of the study. DynaMed users reported a Cohen''s d increase of +1.50 compared to AccessMedicine users'' reported use of 0.82. DynaMed users reported d2 satisfaction increases of 9.48 versus AccessMedicine satisfaction increases of 0.59 using a Cohen''s d.

Conclusion

Participants in the DynaMed arm of the study used this clinically oriented PoC more heavily than the users of the textbook-based AccessMedicine. Electronic information resources now provide easy access to current health information and summarized forms of evidence to support clinical decision making.

Access effects on health care

Health care providers who are affiliated with well-funded institutions benefit from access to a variety of high-quality information resources to support their evidence-based practices. Practitioners who are not affiliated with academic health sciences centers rarely have access to these same resources due to prohibitively high licensing costs. Ely et al. report that not having access to easy-to-use, high-quality, current information can negatively affect sound clinical decision making. [1].Patients in Isaac et al.''s study who were admitted to hospitals that had access to an electronic evidence-based resource experienced reduced length of stay and lower risk-adjusted mortality rates for prespecified conditions [2]. That study was validated on a broader scale by a multicenter investigation on the utilization of information resources by practitioners [3].Primary health care practitioners who are not affiliated with academic health sciences centers, particularly those who practice in rural or remote areas, often articulate the need for increased access to health information resources. The authors'' literature search and review of 114 of the most relevant research articles about the information needs and information-seeking behavior of health care practitioners suggested that these professionals most value speed and accuracy. For example, they likely would prefer to use point-of-care (PoC) resources for quickly and accurately answering their clinical questions.

Desirability of point of care

PoC resources quickly guide physicians through the diagnosis, treatment, and management of commonly encountered clinical conditions. PoC resources can present compilations of highly authoritative, often evidence-based, information. Physicians can answer more questions and revise clinical decisions more often using these PoC resources [4]. Meanwhile, many health care practitioners still rely on textbooks familiar to them from their professional training programs, despite their potentially dated contents [514].

Limited access in rural New Mexico

A randomized controlled trial involving public health practitioners across the rural state of New Mexico reported many barriers in accessing valued information resources [15, 16]. In another study, researchers in New Mexico set out to determine and analyze information needs of health care practitioners who were not affiliated with an academic center. Fifty-one interviews of rural physicians, nurses, physician assistants, and nurse practitioners showed both a need and desire for access to information resources [17].

Goals and hypothesis

This study sought to determine which rural health care providers found more useful in answering everyday clinical questions: electronic PoC DynaMed, which is more clinically oriented, or electronic PoC AccessMedicine, which consists primarily of a health sciences textbook collection. We hypothesized that free access to the explicitly clinical format of the PoC resource DynaMed would result in more extensive use than a baseline of zero over a six-month period than the electronic PoC textbook collection AccessMedicine. We felt this would be due to greater utility of DynaMed in clinical practice. We also predicted that clinicians using the clinically oriented PoC would express higher levels of satisfaction than those using the textbook-based PoC and that clinicians using these PoC resources would prefer using them over other information resources.  相似文献

Abstract

Customer orientation has been suggested to create competitive advantage of firms (Kohli &; Jaworski, 1990 Kohli, A. K. and Jaworski, B. J. 1990. Therefore, the recommendation to media managers has been to let the creation and delivery of customer value guide their strategies for advertising sales (Aris &; Bughin, 2005 Aris, A. and Bughin, J. 2005. Managing media companies: Harnessing creative value, Chichester, , England: Wiley.  [Google Scholar]). However, the concept of customer value, what it is, and how it is created remains unclear in many ways. This article explores the concept of customer value in advertising media purchasing from the media seller's perspective. Between December 2007 and February 2008, sales representatives from three Swedish TV networks were studied through in-depth interviews and observations as they progressed through a negotiation process with a large advertiser and its media agency. A qualitative analysis of the media sellers' experiences shows that they see advertiser and agency to perceiving the value of advertising media differently. Also, they see the customer side parties as diverging in the processes by which these value perceptions are formed. The article reveals the inherent problem of customer orientation on advertising markets—that within media purchasing practice, several actors have their own idea of value, and an advertiser's understanding of value is not always a decisive factor.
