As an important part of cultural and ideological progress construction,the improvement of Chinese modern legal system has become a keynote in the process of constructing the harmonious society in China.In the course of the development of Chinese legal system,transplanting from western legal culture is becoming a trend.Therefore,it is necessary to study the difference between Chinese and western legal culture and its influencing elements so as to provide a cultural basis for this transplant.As for cultural factor,Confucianism is the dominated thoughts in traditional Chinese history and Christianity occupies the same place in western culture,accordingly,their influence on the difference between Chinese and western legal culture is great.This paper discusses the difference of the obligation orientation and right-based principle between Chinese and western legal culture influenced by Confucianism and Christianity aiming at provide some important inspirations for the transplant of western legal culture in improving Chinese modern legal system. 相似文献

As is known to everyone, Henry David Thoreau was an outstanding American writer in the 19th century. However, he did not attract much attention at that time. In fact, Thoreau did not have a profound influence on American culture until the 20th century. It is generally acknowledged that his masterpiece Walden is one of the most outstanding literary works, in which the richness of thoughts contributes greatly to the spread of Thoreau's philosophy. Thanks to it, Thoreau's philosophy has attracted more and more attention. It is pleasantly surprised for a Chinese reader to find Confucianism in an American classical work of the 19th century. Many scholars have studied Confucianism in Walden in order to analyze how Confucianism influences Thoreau. However, these studies more or less overstate or understate the influence of Confucianism. Therefore, such a research does have great practical significance, that is, to objectively analyze how Confucianism influences an American writer and how it is repre?sented in his representative work. 相似文献

This is a very timely book,as the international educational community becomes more and more aware of the shift in global geo-politics towards Asia,and the likelihood that Asian educational ideas and values will have a more direct and explicit influence on educational policy and cultures of learning and teaching in future.The high scores of East Asian students in TIMMS and PISA have already attracted considerable attention,but little is known of the deep underlying culture of learning and thought that goes back to the axial age and Kong Qiu,the Chinese philosopher who lived from 551 to 479 BC,and was introduced to 16th century Europe as Confucius or the Master Kong (Kong Fuzi).Most recently,China has launched a unique approach to cultural diplomacy in the establishment of hundreds of Confucius Institutes around the world,most as joint ventures between Chinese universities and school boards,universities and NGO's in more than 90 nations or regions.So far,most of these institutes have focused on the teaching of Chinese and the training of Chinese languages teachers,few have the capacity to introduce or explain the rich educational and philosophical heritage that is summed up in the term Confucianism. 相似文献

Equivalence in translation was first put forward by Firth. It has been the nuclear topic of translation studies in western countries."Functional equivalence", Eugene Nida’s key notion of translation theories, advocated the receptor-oriented translation standard. Through the contrastive study between Xi Youji and its English version Journey to the West, the content focuses on the translation of the verbal predicates and aims at studying the application of transitivity theory into Chinese-English translation and finding out the improved translations of Chinese and English examples of different processes. Due to limited article, this paper only discusses three of six processes in the concrete context and provides new translations for the questioned ones. Finally, the last part summarizes that the functional equivalence can be achieved when verbs referring to process of action share the same semantic attribute with the Chinese originals, so the English version of Xi Youji should be further perfected according to transitivity theory. 相似文献

Few studies are involved with the new-type dictionary. Some researches have been conducted concerning the Markedness Theory about the marked and the unmarked, from aspects of Phonetics, Grammar, Pragmatic, Psycholinguistic and Sociolinguistic. Few researches have combined the Markedness Theory with literature theories and even no research has been done to study the Feminism Theory from the perspective of the Markedness Theory. This paper discusses markedness theory with regard to two basic issues: Why it is ok to say"历史"in Chinese, but the equivalent in English is"history", not"*herstory". Why the meaning of"governor"and"governess"is distinctively different? No research concerning the issues from the perspective of markedness has been conducted yet. The construction of the cables is a key step for erecting suspen-dome structures. In practical engineering, it is difficult to ensure that the designed pre-stresses of cables have been exactly introduced into the structures in the site; so it is necessary to evaluate the influence of the variation of the pre-stresses on the structural behavior. In the present work, an orthogonal design method was employed to investigate the pre-stressed cables' sensitivity to the suspen-dome system. The investigation was concentrated on a Kiewitt suspen-dome. Parametric studies were carried out to study the sensitivity of the structure's static behavior, dynamic behavior, and buckling loads when the pre-stresses in the cables varied. The investigation indicated that suspen-dome structures are sensitive to the pre-stresses in all cables; and that the sensitivity depended on the location of the cables and the kind of structural behavior. By reviewing evaluations collected via interviews from supervisors and employees in different companies, the author tries to pinpoint the extent to which a given corporate culture is applicable in a different cultural context. These studies present the results from really HR-audits. The study deals with the influence of corporate culture. This case study is about a German establishment in the United States （mechanical engineering industry）. The results clearly reveal that the acceptance of a corporate culture in a foreign cultural context is very low among the employees of the host country, regardless of the cultural patterns in the individual cases. The attempt to implement at any price a given concept of motivation programs and human resources development measures has held negative effects instead of positive effects on work efficiency and on the commitment of staff. The results will be critically analyzed. Psychological implications will be worked out and general trends are discussed. 相似文献
