亲权是现代各国民法规范亲子之间保护教养关系的一项重要法律制度。它是指父母对未成年子女在人身和财产方面的管教和保护的权利和义务的总称，属于民事权利中的的身份权，具有权利义务的双重性，专属于父母享有并且属绝对权、支配权，同时具有一定的时间性。建立亲权制度既有利于完善我国婚姻立法，也有利于保护未成年人合法权益，适应我国社会主义市场经济发展的需要。我国未来亲权立法应包括亲权主体、亲权内容、亲权的行使与限制、亲权的停止与消灭等制度。 相似文献

在《民法通则》中没有设立完整意义上的亲权制度，而是将父母对于未成年子女人身及财产上的监护保护置于监护制度的调整范围，在立法上混淆了监护和亲权两种法律制度。由于社会经济关系发生的巨大变化，我国现行监护制度的局限性逐步暴露出来。构建我国的未成年人监护制度应立足于中国国情，就目前的条件而言，尽快地修改现行的监护法，合理明确地立法是完善监护制度的前提。 相似文献
