在我国,大多数刑事案件的被害人都无法足额拿到赔偿款。被害人国家救助制度体现了人道主义价值,促进了三位一体刑事政策的形成,与和谐司法的理念一致。建立和完善我国的刑事被害人国家救助制度,在现行法律的指引下,明确赋予被害人及其家属的救助申请权,建立财政专项资金,保障所有案件的被害人都能平等得到赔偿金,确保被害人的基本生活是该制度设计中的重要问题。 相似文献

我国立法关于疑罪不诉程序的规定存在被害人权利保障不足、被害人补偿机制缺乏、被害人权利膨胀可能、诉讼代理人权限有限、法律援助方面的制约等问题.应对疑罪不诉程序进行诉讼化改造,进一步落实被害人的程序参与权,确立不起诉听证制度和不起诉司法审查制度,引入被害人国家补偿制度,完善律师代理制度和法律援助制度. 相似文献

目前,被害人的权利救助在国际上日益受到重视,我国对"特困被害人"的救助也比较关注,2004年国家将"尊重和保障人权"写入宪法.但应如何救助,救助的标准、尺度,仍在探讨过程中.本文从刑事被害人救助制度的现状入手,阐释了建立刑事被害人国家救助制度的价值,最后以提高刑事司法效益为目的,建议应建立和完善"特困被害人"国家救助制度.以国家专门立法的形式,对国家补偿的对象、原则、补偿的机构及资金来源、补偿程序等内容予以规范,以加强人权保障,促进我国刑事法治的完善和社会主义和谐社会的建立. 相似文献

刑事被害人精神损害赔偿问题一直是困扰我国司法实务界和理论界的一个重大而现实的问题。现阶段关于刑事被害人精神损害赔偿请求权的理论之争以及对此问题存在的司法困境,主要是由于立法层面制度的不协调造成的。在我国,对刑事被害人精神损害赔偿制度之争聚焦在两个方面:其一,在实体上是否应当确立刑事被害人精神损害赔偿制度;其二,刑事被害人精神损害赔偿采用什么程序加以保障。立法应当确认刑事被害人请求精神损害赔偿的实体权利和诉权以确立刑事被害人精神损害赔偿制度;完善刑事附带民事诉讼程序以及赋予刑事被害人请求精神损害赔偿的程序选择权,从而建立程序保障机制。从制度建设层面完善刑事被害人精神损害赔偿制度建构,才能正本清源。 相似文献

During interview with English majors, it was found that a majority of students expressed disappointment with their experience of English literature classes. Students' dislike of learning English literature appears to be the major problem of teaching English literature in China. Reader response approach is a good way to solve this problem. In this paper, I explain the rationale behind the reader response approach, such as its origin, definition, features, assumptions, and strategies. Then I illustrate how reader response approach works as a teaching strategy by presenting several teaching models.
