商行为存在民事行为所不能包容的特殊性,具有相对独立的价值。如不在民事行为制度之外设立商行为制度,就无法有效地调整因商行为而产生的法律关系,以维护商事交易的安全。受民商合一法律传统的影响,我国立法尚未独立的商行为概念,仅仅在商事单行法中确立有限的商行为制度,商行为立法存在明显的缺陷与不足。因此,在立法理念上强化商行为制度的立法价值,加强商行为立法,构建商行为制度已成为我国现实的商事立法需求。 相似文献

20世纪80年代到90年代中期是我国转型开始的时期,安定团结的需要使得"秩序至上"成为这一时期信访制度的精神与核心,这一精神很好地体现在这一时期全国各省的信访立法中。这些省份的信访立法文件大多在其开头就表明其宗旨是维护信访秩序,为了贯彻这个宗旨,这些立法内容的重点均表现为对信访人的限制,特别是防止集体上访,而且这些立法把信访体系的工作方针定性为"分级负责,归口办理",这正好吻合科层制的要求,而科层制则又是秩序价值的另一种体现方式。这一时期虽然在少数省份的信访立法中我们能看到少许维权的曙光,但是这些曙光依然被淹没在秩序至上的总体价值之中。直到90年代中期及至当前,维权的价值才慢慢体现于信访制度中。 相似文献

我国两岸四地关于建筑物区分所有权立法均经历了一个曲折发展的历程。四地立法目的是一致的,但具体规则各具特色,因而回顾四地立法进程有助于更好地认识该制度之价值,并总结立法启示如下:建筑物区分所有权制度是社会经济发展之产物,它的发展完善亦促进了社会经济的进一步发展,而政府部门与居民在区分建筑物的管理和维护中都起着举足轻重的作用。 相似文献

限定继承是我国继承法的主要制度之一,这一制度将继承人清偿被继承人的债务限定在遗产范围之内。其立法的目标价值是平衡遗产继承人和遗产债权人的利益。由于我国《继承法》在法律制度整体构架设计上的结构性缺失,使得这一制度没有实现其目标价值和发挥预设的规范功能。本文主要借鉴外国成熟的立法经验,根据我国继承实践的需要,从理论的层面上进行探讨,以期对完善我国继承法尽微薄之力。 相似文献
