随着分类管理改革的推进,现有民办高校将真正分为营利性和非营利性两种不同的法人组织。法人属性的差异,意味着民办高校内部治理机构的调整和变化。从公共性视角来看,目前我国现有民办高校内部治理呈现出较为典型的私人性特征,表现在治理目的、治理主体、治理机制等方面。对于非营利性民办高校来说,其内部治理从私人性转向公共性,是现代大学公共属性、民办教育政策导向、获取公共财政支持的综合使然。提升非营利性民办高校内部治理的公共性,应形成树立以公共利益最大化的治理目的,构建多元共治的治理主体,建立公平、透明的治理机制。 相似文献

一、教育“非营利性”的基本概念
在我国目前的教育法规体制下，教育机构是“非营利性”的．这一规定主要是指我国《教育法》第25条：“……任何组织和个人不得以营利为目的举办学校及其他教育机构。”在此基础上，现行的《社会力量办学条例》第6条和《中外合作办学暂行规定》第5条，都重申了教育“非营利性”原则。但是，对于这样一个原则性的规定到底具有什么可操作性的含义，并没有一个正式的立法解释。 相似文献

农民生态道德的培育是一个系统工程,农民生态道德培育涉及到参与生态治理的政府、村级组织及企业等人类行动者以及生态制度规范、传统村庄生态智慧等非人类行动者。在政府作为主导行动者的推动下,行动者网络进行了“转译”,但单向度行政力量使“转译”行为陷入僵化,企业的市场化行为使“转译”行为陷入封闭,集体公共性的缺失使“转译”行为陷入悬浮。为了推动农民生态道德的培育,应进一步加强政府与村庄协同效应,强化政府与企业的精细合作,增强以农民为本位的生态道德公共性。 相似文献

“县管校聘”是对教师资源配置行政权力的整合,是新时代政府公共职能的显著体现。“公共性”向度可以从根本上解释我国现阶段中小学教师人事管理制度改革的逻辑框架,就是政府要求教师以优质教育资源供给的形式提供公共服务。“县管校聘”面临困境的本质是“公共性”缺失的问题,具体表现为政策缺少法源性支持、机制架构引发利益相关者间的博弈以及伦理品质的流失等。“县管校聘”的有效执行需要教育公共性理念的合理复归,通过确立教师职业专业性与公共性统一的法律地位、推进区域整体化治理、构建多主体协同的有效模式,同时借鉴人力资源管理的视角提升教师资源配置活力等举措来实现。 相似文献

《民办学校分类登记实施细则》第7条规定，非营利性民办学校可以登记为事业单位。这不仅与《民法典》等上位立法发生冲突，存在操作障碍，而且背离事业单位改革趋势。产生该规定的根源在于未能科学认识我国非营利性民办学校的法人类型。对此，应回到基本法层面，对非营利性民办学校的法人类型予以体系化重释。一方面，坚持事业单位法人的国有属性，将其从民办学校法人类型体系中去除；另一方面，摈弃将非营利性民办学校统一定性为捐助法人的解释范式，承认社团型非营利性民办学校这一类型。同时，配套完善非营利性民办学校扶持及国有资产监督管理机制，从而形成社团型非营利性民办学校与财团型非营利性民办学校并存的“新二元体系”，从根本上解决非营利性民办学校的法人地位问题。 相似文献
