在推动民事审判方式改革的今天,如何对检察机关的民事检察监督职能进行定位是我们必须面对的课题。基本思路是,一方面,基于现实的需要,我国保留检察机关提起民事抗诉具有现实合理意义,但应当在受案范围等方面予以收缩。另一方面考虑到世界检察制度的发展趋势,在我国很有必要建立民事公诉、参诉制度,以实现检察机关在民事诉讼中的职能扩张。 相似文献

检察机关在民事诉讼中有诉讼职能与监督职能,我国民事诉讼法没有赋予检察机关提起民事诉讼的权力,只享有法律监督这一职能。从监督职能行使的目的、动机来看,民事检察监督有救济性监督和督察性监督两种类型。救济性监督以救济当事人的权利为主,以监督为辅,因而在处理与当事人诉权关系时,应坚持尊重和保障诉权以及救济的补充性和适度性原则;督察性监督以监督审判权为主,以救济当事人的权利为辅,在处理与当事人诉权关系时,应坚持监督的优先性和职权强制性原则。 相似文献

民事调解检察监督权,作为新民事诉讼法赋予检察机关的一项新的公权力,考虑到民事诉讼本身属于私权领域,应当尊重当事人意思自治原则的特点,这一监督制度在理解及适用上应该遵照从严解释的原则.无论从文义解释、立法解释还是从体系解释的角度,新修订的民诉法所规定民事调解检察监督的范围不包括违反自愿原则、合法原则以及损害第三人利益这三种情形.民事调解检察监督的范围主要包括代表国有资产一方放弃国家利益;利用调解书规避行政处罚或者强制执行以及民事调解书内容损害国家、社会公共利益等三种形式.检察监督的方式包括抗诉、检察建议及移送立案侦查等三种方式. 相似文献
