换锁出租他人不动产行为是否构成刑法上的犯罪行为,理论上存在争议.通过对司法实践中的案例进行分析,能够帮助我们确定此类民刑交织案件的分析逻辑.结合法益保护以及社会危害性理论,对换锁占屋以及冒名出租两个阶段的行为进行全面考察后,上述行为不宜仅被认定为民法上的不当得利,应构成刑法上的盗窃罪. 相似文献

在"中国古代只有公法(刑法)没有私法(民事法)"等观念的影响下,法律史学界的契约研究也呈现出"国家"缺席的状态。但通过对清代各类法律文献想梳理和契约文本中透露出的信息,我们可以看到,清代不仅制定了详细的和对不动产买卖契约有重要关联的契税制度,而且国家法律对不动产买卖契约的主客体资格、契约的书面规范等都有细致的规定。这些契约规范也和其民族立法精神、治吏思维存在千丝万缕的联系,具有强烈的"公法"色彩。 相似文献

不动产登记以属地登记为基本原则,意味着不动产登记实行属地管辖;不动产的登记机构是其所在地域的登记机构,而不是所在地点的登记机构;不动产所在地的登记机构为唯一的登记机构。其法理依据是不动产登记的功能定位要求、不动产的本质属性、不动产登记的技术。不动产登记制度设立的具体规则包括：不动产登记机关按地域设立;不动产登记实行属地管辖,无级别管辖;不动产登记簿实行物的编成主义。我国《不动产登记暂行条例》体现了不动产属地登记原则,但相关制度仍需进一步完善。 相似文献
