实行过限的认定与责任归属属于两个不同层面的问题。从本质上看,实行过限是行为在主客观层面均予以过限,即主观层面超越共谋范围,客观层面超过共同行为。就过限责任的归属而言,应当联系共同犯罪的结构性特征,按照过限犯罪与共谋犯罪之间的关系分为构成要件重合、交叉以及排斥三种情形,并个别化的予以考察。 相似文献
