2012的修订的《刑事诉讼法》专章规定了未成年人刑事诉讼特别程序,从国家法律的层面初步搭建起我国未成年人司法制度的框架。但作为刑事案件源头性监督手段的立案监督,在现阶段还没有在我国的未成年人司法制度中得到相应体现。本文拟从未成年人刑事案件的特殊性及立案监督的功能性出发,点检未成年人刑事案件立案监督的现状及存在问题,探讨其完善发展的可能路向。 相似文献

立案侦查、审查起诉为审判前程序,即案件交付法院审判之前的诉讼阶段。刑事诉讼法将审判前程序置于十分重要的地位,但对未成年人刑事案件的审判前程序的立法理念不明确;未成年犯罪嫌疑人被强制性纳入诉讼轨道。从保护未成年人刑事诉讼权利、有利于未成年嫌疑人回归社会出发,设立相应过滤机制,避免因未成年人对事物的辨别能力和意识控制能力不强而不能充分享受诉讼权利是必要的。在侦查阶段应区别对待成年嫌疑人和未成年嫌疑人;在审查起诉阶段应建立有利于挽救未成年嫌疑人的起诉制度。 相似文献

我国现行民事诉讼法涉及未成年人民事案件程序方面的规定,已经明显不适应司法实践和保护未成年人合法权益的需要。审理未成年人民事案件应适用与普通民事诉讼程序不同的特别程序。我们应当通过完善立法,明确规定未成年人案件的适用范围、管辖、诉讼主体、举证要求和强制性调解程序的前置、审理等,设立专门的审判组织,通过特别程序来强化对未成年人权益的法律保护。 相似文献

刑事案件撤销导致刑事诉讼程序终结,可能使被害人追诉请求落空,导致被害人＂二次被害＂。从被害人视角看我国刑事案件撤销制度,它完全就是一个由侦查机关按照行政程序作出刑事决定的过程,既剥夺了被害人的知情权、参与权,又限制了被害人获得救济权,有悖程序公正的基本要求。因此,应当借鉴域外先进做法,按照正当法律程序的要求进行改革,加强撤案过程中被害人的人权保障。 相似文献
