商标(俗称品牌、牌子)在社会经济生活中被越来越多的人所追求，一些经营为牟取不正当利益，同时迎合人们的这种需求，于是大量的商标反向假冒行为不断产生。本从新《商标法》对商标反向假冒行为规定为商标侵权行为出发，分析了商标反向假冒行为的主体、构成要件、实施目的、危害性及立法意义。提醒商家不仅要保护自己的注册商标不被他人正向假冒，更应防止他人反向假冒，从而更好地维护其合法权益。 相似文献
