影响力交易是《联合国反腐败公约》的规定,随着公约在我国的生效其国内化也为刑法学界所关注。影响力交易的有关行为在我国现行刑法中的行贿和受贿犯罪中有所规定,但在受贿主体贿赂范围等方面还存在不一致。我国不必直接引进影响力交易的规定,而只要在传统行贿受贿规定的基础上对贿赂犯罪的主体和贿赂的范围上有所调整即可。 相似文献

《联合国反腐败公约》在贿赂犯罪的规定上有许多科学创新之处值得我国借鉴。加入《公约》以来,在刑法方面,我国积极通过颁布刑法修正案以及制定刑法司法解释的方式,不断靠近、衔接《公约》对贿赂犯罪的规定,随着《刑法修正案（七）（草案）》的面世,这种靠近、衔接《公约》的迹象更加明显。在《公约》的带动下,我国刑法促进了贿赂犯罪规制某些方面的发展,而这也必将会对我国转型期贿赂犯罪的严重态势发挥惩治、遏制和预防的作用。但是,与《公约》相比,我国刑法在贿赂犯罪的规制上仍有许多缺位,亟待完善。 相似文献

贿赂外国公职人员或国际公共组织官员罪是《联合国反腐败公约》规定的一类新型犯罪。对这一犯罪,可以从贿赂对象、贿赂范围、贿赂方式等方面加以理解。但是,我国现行刑法中却没有关于贿赂外国公职人员或者国际公共组织官员犯罪的规定,这不合国际商务反腐的潮流。从现行刑法与国际公约的协调与接轨方式看,有必要将贿赂外国公职人员或国际公共组织官员罪纳入我国刑法范畴。同时,我国刑法在规定这一犯罪时,应注意刑法与《公约》的协调。 相似文献
