法官释明权制度源于大陆法系,在实行当事人主义诉讼模式的国家,释明权制度具有相当重要的意义。当事人主义诉讼模式以辩论主义为基础,但是纯粹当事人主义诉讼模式过分强调法官的消极性,对保障当事人权利,促进诉讼公正,有效率地解决当事人之间的纠纷具有阻碍作用。法官释明权制度设立的初衷即为弥补辩论主义和当事人处分权主义的不足,保障实质正义和当事人的程序利益。在我国民事诉讼模式转型的背景下,释明权制度具有特殊意义。文章通过对释明权制度功能、价值的分析,论述了我国构建法官释明权制度的必要性,并提出明确规定释明权的内容,完善释明权行使的方式,确立释明权救济机制的建议。 相似文献

法官释明权是民事诉讼中的重要制度。我国现行《民事诉讼法》并未对法官释明权制度作出明确规定,仅在一些司法解释中出现了个别类似规定,且这些粗线条的规定对释明权的主体、范围、行使时间等均未加以明确。建立我国完善的法官释明权制度,应当对释明权的适用范围、行使时间、行使方式、后果救济等方面进行规范,确保司法实践中法官的权力行使有法可依。 相似文献

法官释明权制度存在的合理基础是通过强化法官的程序控制功能,对完全当事人主义民事诉讼模式的缺陷进行限制与修正,但过度释明极易破坏法官的司法中立地位,进而危及司法公正,从而使设立这一制度的本意发生异化。为保障法官释明权的正当行使,应创设协同型的诉讼模式,并从保持程序控制和法官中立的维度出发,确立积极、适度、公正行使释明权的三项原则,在将释明权定位于法官职权的基础上,建立释明权不当行使的救济机制,以纠正法官释明权的不当行使。 相似文献

德国民事诉讼法最早确立了释明权制度，这种制度被视为职权主义的固有内容。通过分析释明权制度与两种诉讼模式的关系，可以看出，释明权虽然脱胎于职权主义，如将其融合于当事入主义，将能够克服当事入主义所带来的弊端，故该项制度有其存在的必要，并能为我国民事诉讼制度改革提供借鉴。 相似文献

法官释明权最早出现于德国,与职权主义审判模式紧密相连。在我国,释明权初步确立于最高人民法院《关于民事诉讼证据的若干规定》第35条,即"诉讼过程中,当事人主张的法律关系的性质或者民事行为的效力与人民法院根据案件事实作出的认定不一致的,不受本规定第三十四条规定的限制,人民法院应当告知当事人可以变更诉讼请求。"但从总体而言,我国仍缺乏一套完整的法官释明体系。本文从释明权的概念、性质、特征出发,分析我国之所以需要建立一套系统的释明制度的必要性,并讨论释明权行使应受之限制,以便为实践当中法官释明活动提供理论参考。 相似文献
