为妥善解决实际工作中的问题,更好地保障职工和用人单位合法权益,2013年4月25日,人力资源和社会保障部颁布了《关于执行〈工伤保险条例〉若干问题的意见》(人社部发〔2013〕34号),该意见共包含14条内容,对工伤认定、劳动争议处理具有很好的指导作用:劳动关系存异议,工伤认定应中止。该意见第5条明确规定,社会保险行政部门受理工伤认定申请后,发现劳动关系存在争议且无法确认的,应告知当事人可以向劳动人事争议仲裁委员会申请仲裁。在此期间,作出工伤认定决定的时限中止,并书面通知申请工伤认定的当事人。劳动关系依法确认后,当事人应将有关法律文书送交受理工伤认定申请的社会保险行政部门,该部门自收到生效法律文书之日起恢复工 相似文献

针对现行法律法规规定的劳动仲裁时效制度的弊端,包括把"劳动争议发生之日"等同于"知道或者应当知道权利被侵害之日"违背《劳动法》立法初衷、仲裁时效过短、缺乏时效中止、中断、最长时效保护规定等,根据《劳动法》立法宗旨,结合中国当前劳动关系发展的状况,提出了完善劳动仲裁时效制度的几点建议:一是对"劳动争议发生之日"应当理解为"一方当事人知道权利被侵害而向对方当事人明确表示异议之日".二是适当延长仲裁时效为6个月.三是参照民事诉讼法规定,建立劳动仲裁时效中止、中断、权利保护最长时效制度. 相似文献

Aninequality is established, which reveals that the difference between the squared circumradius of the n-dimensional simplex andthe squared distance between its circumcenter and barycenter times the squared circumradius of its inscribed simplex is not lessthan the 2(n-1)th power of n times its squared inradius, and is equal to when the simplex is regular and its inscribed siplex is atangent point one.
