The role electronic resources librarians (ERLs) have in licensing electronic content is the most relevant in the breadth of an ERLs core responsibilities. While ERLs are rarely lawyers in addition to being librarians, the role they play in educating stakeholders, negotiating with publishers and vendors, and crafting understanding of licensing terms is integral for the success of a rapidly growing and changing electronic collections environment. Often, new ERLs have to learn these skills on the job. Discussed are tools and resources for new ERLs to build their electronic content licensing competency and insight on how to educate to advocate for the ERLs role in licensing.  相似文献

For publishers and librarians to work well together it will help for publishers have a good idea of the circumstances and challenges currently facing libraries. This includes but is not limited to budget; libraries also struggle with a complex technology environment, quickly changing licensing, pricing and content options, and incomplete adoption of standards by publishers and software vendors. Although many hospital librarians may find it difficult, negotiating with vendors has become a basic skill of library acquisitions. This article reports the results of a non-scientific questionnaire administered to hospital librarians and vendors attending a chapter meeting of the Medical Library Association in 2003. The answers revealed that vendors regard libraries as businesses, and while admitting that the role is often uncomfortable for them, librarians acknowledged that negotiating skills have become an important aspect of their jobs. STM represents 250 publishing companies and learned societies, and recognizes that the advent of digital networks affects authors, publishers, librarians, and readers. Dialogue between publishers and librarians is essential to creating the sense of partnership and open-mindedness needed to meet the future needs of scholarship and research. Publishers and librarians have complementary roles and responsibilities, serving the same needs and facing similar challenges. The interests of publishers and librarians need to be rebalanced in order to seize the benefits of digital information flow. Legislation provides a framework of copyright, privacy, competition, and consumer law that protects against misuse while facilitating the flow of information from author to reader. If laws need to be amended, such changes should be made on the basis of the mutual agreement of all members of the community. There is much to be achieved without legislative change. Neither publishers nor librarians should shy away from the issues that divide them, especially the scope of fair use and the exchange of copyright information between libraries. A more detailed analysis of the impact of copyright exemptions is needed. The development of a predictable licensing environment and the testing of new business models requires co-operation between publishers and librarians, and leads to better mutual understanding. STM seeks dialogue with libraries and with other members of the research and scholarly communities in order to meet the challenges, opportunities, and expectations created by the digital environment.  相似文献

The licensing of electronic resources continues to challenge libraries as they acquire new resources. Claire Dygert, Assistant Director for Licensing and E-Resources, Florida Virtual Campus (FLVC), presented key components of a license agreement, including examples and sample clauses. The development of local licensing guidelines makes licensing work easier by providing more consistency in the approach to license review and by making the practice and policy of the institution the basis of the licensing review.  相似文献

In this session of the NASIG and Society of Scholarly Publishing joint program, a panel of lawyers conversed on topics related to the creation of copyright policy that impact both librarians and publishers. The topics chosen were selected to highlight areas of possible controversy between librarians and publishers. Dialogue centered on the concepts of international first sale, fair use, licensing and mass digitization, library exceptions, possible revisions to sections of the U.S. Copyright Act, and the relationships between accessibility issues and copyright. Through conversational style discussions the panelists conveyed to the audience that achieving balance in copyright law is challenging and the process often creates constructive tension among the rights of stakeholders.  相似文献

Licensing and the negotiating of electronic resources can be a daunting task for librarians who lack the proper skill sets and are unfamiliar with the intricacies of publisher agreements. Claire Dygert broke down the individual elements of a standard licensing agreement and explained the importance of protecting the rights of libraries. By providing insight from her years of experience, librarians learned how to develop a support network, build confidence, and be more effective negotiators.  相似文献

Scholars increasingly use text and data mining (TDM) methods to discover trends and relationships within complex digital data sets. In order to support this development in scholarly communication, librarians and publishers need to be knowledgeable about TDM methods, build partnerships with TDM researchers, and address challenges related to licensing and access to large document sets. The presenters of this NASIG session shared their experiences of supporting TDM as a library subject liaison, acquisitions librarian, and publisher representatives. Audience members discussed issues involving TDM of data from multiple publishers, local hosting of data sets and TDM activity by undergraduate students.  相似文献

The license negotiated at the beginning of the electronic resources lifecycle impacts access to the resource throughout the life of the contract. To simplify the negotiating process, the Texas A&M University (TAMU) Libraries developed a licensing checklist. In order to make completed licenses accessible to all library personnel, the TAMU Libraries use the electronic resources management system Centralized Online Resources and Licensing (CORAL) to store license documents and terms. This presentation reviewed the TAMU Libraries’ licensing process, the creation and evolution of the licensing checklist, and the suitability of CORAL to share license details. The presenters also recounted several examples of difficult negotiations and license violations.  相似文献

This article will describe a year-long (2010–11) joint project between Columbia University Medical Center's Health Sciences Library and the Institute for Family Health (IFH), a network of Federally Qualified Health Centers (FQHCs) serving disadvantaged populations in New York State. This National Institutes of Health-funded pilot project aimed to (a) determine the medical literature and training needs of IFH personnel, (b) develop generic licensing agreements with publishers that would enable a health sciences library to provide access to electronic resources for FQHC personnel, and (c) develop reference/education services for IFH personnel. How the reference and education aims were met will be described and discussed here as the lessons learned from this project may be useful to librarians considering doing instructional outreach to unaffiliated health professionals working at FQHCs nationwide.  相似文献

Nonfiction for young adults is enjoying a rebirth of interest among publishers, librarians, and teachers with the emergence of an approach that uses facts as information to be shared with children trying to make sense of their world. Reading interest studies disclose patterns in young readers' preferences in nonfiction. Suggestions are offered to encourage the reading of nonfiction, to help teachers use these books effectively in classroom discussion, and to help select nonfiction for reading aloud. He has been president of the National Council of Teachers of English Assembly on Adolescent Literature. He and Betty Carter edited the 1988 edition ofBooks for You: A Senior High Booklist for NCTE, and the two also publishedNonfiction for Young Adults: From Delight to Wisdom from Oryx Press. Changes in the practice of medicine and technological developments offer librarians unprecedented opportunities to select and organize electronic resources, use the Web to deliver content throughout the organization, and improve knowledge at the point of need. The confusing array of available products, access routes, and pricing plans makes it difficult to anticipate the needs of users, identify the top resources, budget effectively, make sound collection management decisions, and organize the resources effectively and seamlessly. The electronic resource marketplace requires much vigilance, considerable patience, and continuous evaluation. There are several strategies that librarians can employ to stay ahead of the electronic resource curve, including taking advantage of free trials from publishers; marketing free trials and involving users in evaluating new products; watching and testing products marketed to the clientele; agreeing to beta test new products and services; working with aggregators or republishers; joining vendor advisory boards; benchmarking institutional resources against five to eight competitors; and forming or joining a consortium for group negotiating and purchasing. This article provides a brief snapshot of leading biomedical resources; showcases several libraries that have excelled in identifying, acquiring, and organizing electronic resources; and discusses strategies and trends of potential interest to biomedical librarians, especially those working in hospital settings.  相似文献

Since the 1930s, the Library Bill of Rights has acknowledged the ethical responsibility of librarians to provide access to information in all formats to all people. Librarians are charged with selecting, organizing, and instructing patrons on how to locate and use the resources, and preserving information regardless of format or technology. The information revolution and the pervasive thinking that everything is available on the Web have created new challenges to these traditional professional ethics. Acquiring and providing dependable access to electronic resources require librarians to learn and apply new skills such as negotiating license agreements and understanding evolving technologies. Print publications provide a degree of permanence, but e-information, if it is not properly managed, can be highly transient. Internet services provide large, uncontrolled, unregulated collection of resources. If the very nature of the Internet makes it nearly if not completely impossible to evaluate the content of web-sites, how does the librarian protect the integrity of the information the library provides? Along with traditional ethical conflicts, librarians in the virtual library are faced with new challenges to provide equitable access to usefully organized resources, to address petitions to deselect or filter, to negotiate less-restrictive licensing policies, and to maintain the anonymity of individual users within electronic transactions.  相似文献
