孟连傣族习惯法规定了拾得者一定的义务,同时也规定了拾得者的报酬请求权及一定条件下可以取得遗失物所有权的权利。这些规定与《民法通则》及《物权法》的规定很不相同,这两部法律均否认了拾得者的报酬请求权及取得遗失物所有权的权利。两相比较,孟连傣族习惯法的规定更为合理,既符合伦理学中人性类型的相对数量统计性规律,也符合经济学原理;同时,从实际效果来看,赋予拾得者这些权利取得的效果也更好。事实上,正因为法律规定的不合理,在我国的司法实践中,对拾得遗失物也未严格按法律的规定处理。 相似文献

Comparing self-perceived quality of teaching to students’ perception can be used in higher education to improve the quality of teaching of pre-service teachers in teacher education. However, comparing these measurements from different perspectives is only meaningful if the same constructs are being measured. To shed light on this comparison’s meaningfulness, we scrutinised whether aspects of quality of teaching are measured in the same way across pre-service teachers and their students by means of measurement invariance analyses. To do so, 272 pre-service teachers in teacher education rated aspects of their quality of teaching, and were rated by their 4851 students. Measurement invariance across these perspectives was tested in multilevel structural equation models. Strong measurement invariance held for two aspects of quality of teaching; for the third, one item lacked weak measurement invariance. Pre-service teachers perceived their quality of teaching lower than their students. In conclusion, aspects of quality of teaching can be compared across perspectives, and teacher education should encourage pre-service teachers to use students’ feedback as a valuable resource for improving their quality of teaching. 相似文献

Far from all who complete teacher education end up working as teachers throughout their entire career. At first sight the value of teacher education, in terms of efficiency, seems to be a failure. In the present article we argue that teacher attrition, when defined as whether one is working as teacher or not, is a too blunt measure to gauge whether teacher education has been valuable. With a unique dataset, where we have detailed information on 87 Swedish teacher graduates’ working life across 23 years, we can consider whether activities and/or experiences point to an apparent use of teacher education. In conclusion, we find that in order to get informative estimates of its value it is important to consider it from different perspectives and to consider attrition related to the total working time spent in educational settings across a career rather than percentage leaving teaching after a set of years 相似文献

Framed by the EU-project Hand in Hand focusing on Social, Emotional and Intercultural (SEI) competencies among students and school staff the paper discusses implementation and professional competencies based on a literature review. Five themes were identified: 1) Intercultural/transcultural competency is not often referred to in the same research as social-emotional learning, though socio-emotional aspects appear to be `in the core´, 2) it is crucial to be aware of agency among school staff in a SEI-implementation, 3) successful implementation is about more than the activities in the specific program, it is rather about elements in synergy and professional learning over time, 4) the subtle balance between adaptation and fidelity might best be addressed in an adaptive curriculum emphasizing active ingredients, and 5) this is a field with many intervention studies, but it is urgent to consider if the psychometric measures are sufficiently sensitive to catch the subtle changes related to SEI-competencies. 相似文献

This study explored the integration of technical vocabulary into pre-observation conferences and its influence on English teachers’ professional learning and discussion in their post-observation conferences. The conceptual framework based on Harvey [2011. “A Sociocultural-Theory-Based Study of the Impact of Mediation During Post-observation Conferences on Language Teacher Learning.” Unpublished doctoral diss., University of South Florida] and Goe, Biggers, and Croft [2012. Linking Teacher Evaluation to Professional Development: Focusing on Improving Teaching and Learning. Denver, CO: National Comprehensive Center for Teacher Quality] was used to analyse the questionnaire, audio recordings, and documents collected in seven peer observations of teaching in Taiwan. This study has two major findings. First, English teachers regarded the technical vocabulary as stimuli for their professional learning; however, the range of technical vocabulary used during the post-observation conferences was limited. Second, three major factors affected their use of technical vocabulary. A new model was proposed in order to effectively integrate technical vocabulary into peer observations of teaching for elementary school English teachers’ professional learning. 相似文献
