契约法宪法化是私法宪法化的一个重要组成部分。它与现代私法的两个发展趋势紧密相连,原因在于由于高度专业化而导致的弱势群体保护。宪法权利对于私法有直接效力与间接效力两种学说。在契约法宪法化领域,德国与英国已经出现了相关判例。契约法宪法化对我国有一定的借鉴意义,但是关键在于要适当限制契约法宪法化问题的适用以及适用方式。  相似文献

《民办教育促进法》有关民办学校终止的规定还不够具体、详细,存在关于民办学校终止的原因规定不全面、没有规定民办学校解散的原因、有关民办学校清算的规定不详细、对学生受教育权保护力度不够等问题。民办学校的终止,可将《民法总则》中的指导原则作为重要法律依据。在今后的民办教育立法中,应加强民办学校终止的法律制度建设,促进民办教育健康有序发展。  相似文献

The growing number of private schools in India, especially those accepting children from underprivileged households, has been considered demand driven. In contrast to this understanding, this paper argues that low-income parents in Okhla and Badarpur in Delhi, India, are compelled to send their children to private unaided recognised and unrecognised schools. These schools are used as interim schools during primary or elementary grades because of the perceived danger of sending younger children to distant government schools. Our findings show that parents encounter school choice dilemmas in three stages. Parents prefer sending their children to government schools, but being Muslim, they also prefer faith-based teaching in an Islamic environment, which they expect from government schools but not from private schools. Moreover, they prefer schools that offer all grades, do not charge fees, and have honest teachers who teach effectively, are dedicated and affectionate, and will instil discipline in their children.  相似文献

Watermarking is an effective approach to the copyright protection of digital media such as audio,image,and video.By inspriation from cryptography and considering the immensity of the set of all possible wvaelets,it is presented that in wavelet domain watermarking,the associated wavelet can be considered as the private key for encrypting the wavtermark so as to enhance the security of the embedded mark.This idea is partly supported by the fact that from computational complexity viewpoint.It is very time-consuming to search over the immense set of all candidate wavelets for the right one if no a priori knowledge is known about it .To verify our proposal,the standard image“Lena”is first watermarked in a specific wavelet domain,the watermark recovery experiments are then conducted in the wavelet domain for a set of wavelets with the one used for mark embedded in it ,separately.It follows from the experimetal results that the mark can be recovered only in the right wavelet domain,which jusstifies the suggestion.  相似文献

ABSTRACT

Although research on private tutoring has gained visibility in recent years, private tutoring in English (PT-E) has not received notable attention. This paper examines students’ perceptions of PT-E in Bangladesh in terms of its necessity and helpfulness, peer pressure in PT-E participation and ethicality of PT-E practice and government intervention. Our analysis of survey data (N?=?572) leads to characterising PT-E and explaining the reasons for its popularity. As a popular learning space beyond formal schooling, PT-E is available in various forms and quality catering to the purchasing power of different social groups. We argue that students may resort to PT-E not because of its proven effectiveness but because of their declining faith in school English teaching. The paper contributes to our understanding of the complex interactions between the curricular (school) and non-curricular (PT-E) settings and family socioeconomic resources in the teaching of English as a globally desired language.  相似文献
