诉权理论的发展想起他理论的发展一样,总会经历一系列纷繁复杂的路程。大体上来说,诉权经历了由理论到实践,由法律派生权利到国家基本法之上的权利认定,有国内诉权法的规定到国际法上对诉权的认定。本文从诉权的来源入手,以法理学为视角,阐述了诉权的发展历程,进而从两个方面进一步分析了大陆法系中的诉权、英美法系中的诉权、宪法和国际法中的诉权,明确了诉权学说的发展历程,对于诉权的研究具有重要意义。 相似文献

This article reflects on emergent (radical-progressive) languages of democracy to consider what common educational institutions might mean today. It explores distinct philosophical and political tensions that cut across these languages in relation to educational organization and pedagogy including – antagonism versus exodus, transcendence versus immanence, pluralism versus multiplicity, democracy versus communism. In contrast to other theorists in education who have tended to privilege certain conceptual positions in these debates to address a wide range of educational issues, the author argues that these tensions should be read selectively and generatively for linking political questions concerning democracy to educational transformation. In conclusion, the article calls for a language of insurrectional democracy that integrates aspects of each approach and where strategic engagements with, and creative lines of flight out of, public institutions and the State play a role in reimagining a common education for a democratic society to come. 相似文献

Abstract Anxiety disorders are the most common mental health concerns in the United States and they tend to be among the most frequently reported in college mental health. While efficacious research for the psychotherapy treatment of specific anxiety disorders (e.g., social phobia, panic disorder, etc.) exists, the picture is more complex in clinical practice especially with students who are treated as a whole person, usually involving multiple co-existing disorders as well as normal developmental challenges of adjusting to college. This chapter reviews the evidenced-based research for anxiety disorders in both the general population and the college student population, as well as evidence for therapist/relationship factors. It examines the numerous challenges for conducting effectiveness studies in college mental health, suggestions for working with chronically anxious college students, and future directions for research and practice in this area. 相似文献

AbstractThe significance of pointing gestures in the development of linguistic communication is linked to their referential character and formation of common ground in use of gestures and speech. Our longitudinal study aimed to define the nature of this relationship more precisely and to explore whether the relevance vs lack of relevance of a child’s pointing gestures is related to development of language abilities. We developed a special protocol to measure relevant and irrelevant pointing gestures in 18-month-olds, sampled production of spontaneous speech and measured their language comprehension at two years of age. A group of 343 children was tested, and using structural equation modelling we showed that relevant gestures predict the level of development of language production and comprehension. As predicted, this association was not applied to irrelevant gestures. It is likely that a child’s more frequent use of relevant pointing gestures helps the caregiver to recognize the child’s communicative intentions and to comment on his/her behaviour appropriately. The identified developmental/predictive relationship is valid in both mentalistic and teleological interpretation of early communicative development. 相似文献
