In the field of compatibility standards, an increasing number of companies claim to own so-called essential patents (i.e. those patents that are indispensable for designing and manufacturing products conforming to the standard). It is widely believed that the ownership of such patents is a very valuable bargaining tool in cross-license negotiations, while for non-producing firms such patents may result in a substantial stream of licensing revenues. In this paper we study the determinants of essential patent claims in compatibility standards. In particular, we assess the role of two main factors: the significance of the technological solution contained in the patent and the involvement of the applicant of the patent in the standardisation process. We examine the case of W-CDMA, one of the most successful standards in mobile telecommunications. We compare the patents claimed essential for this standard with a control group of randomly selected, unclaimed patents covering the same time period and technology classes. We find empirical evidence that both factors have significant impact on the probability that a patent is claimed as essential, but the involvement in the standardisation process is a stronger determinant than the technical value (‘merit’) of the patent. On the basis of our findings, we offer policy recommendations.  相似文献

Both in the international context and in Flanders (the Dutch-speaking part of Belgium), research shows that many young people experience social exclusion in relation to education. However, research evidence concerning structural social inequality in education is predominantly underpinned by an outcome-based approach, since educational policies and practices are largely informed by a human capital model. Inspired by the theoretical insights of the Capability Approach, we aim to contribute to process-oriented knowledge about the ways in which educational and social welfare actors can support socially vulnerable young people in realising their capability for education rather than focusing on human capital. We draw upon a rich empirical basis of participatory biographical research with young people in the system of part-time vocational education and workplace learning, perceived as the residue of the educational cascade mechanism in Flanders and pertinently revealing problems of social exclusion and exit of young people.  相似文献

Overtraining (OT) as a sports phenomenon can be caused by stressors on various levels (physical, emotional, psychological, and social) and evokes responses on these levels. This study evaluated research and new opportunities in the field of OT by introducing an integrated multidisciplinary approach, based on the single and multistressors approach. The single stressor approach focuses on the training load-recovery imbalance, which results in a stagnating performance, excluding the etiology by nonsport-related factors. The multistressors approach includes all factors as relevant in the etiology of a stagnating performance. In future studies on OT, an integrative approach should not only highlight changes in training regimes and specific responses to training stressors but also focus on the role of training-related recovery, the impact of stressors, and personality factors influencing stress appraisal. This will provide a better insight into the etiology and consequences of OT, necessary for prevention and treatment in sport practice, and enhance the focus on adequate recovery (good sleep, sufficient rest periods) and athletes' stress-related responses.  相似文献

Relationships between ideologies and organizational effectiveness indicators are examined for a sample of 35 university departments. Most differences in research and teaching effectiveness across different fields can be attributed to dissimilar ideologies. Implications for effectiveness evaluations involving university organizations are discussed, and questions are suggested for empirical investigation.  相似文献

This study demonstrates that the concept of paradigm development can explain differences in organizational contexts of university departments. Departments from high-paradigm fields are embedded in a context with clearly identifiable and distinguishable dimensions. In contrast, departments representing lower levels of paradigm development have unclear contexts where major dimensions like size and technology cannot be distinguished from one another. There is considerable interest in the potential non‐musical cognitive and academic benefits of music listening and instruction to children. This report describes three lines of research relevant to this issue, namely, the effects of: (1) focused music listening on subsequent task performance (the Mozart effect); (2) music instruction; and (3) background music listening. Research suggests that while Mozart effect studies have attracted considerable media attention, the effect cannot be reliably demonstrated in children. In contrast, music instruction confers consistent benefits for spatiotemporal reasoning skills; however, improvements in associated academic domains, such as arithmetic, have not been reliably shown. Finally, background music may calm and focus children with special education needs, thereby enhancing learning. Additional research is required to determine whether this effect is evident in normal populations. Overall, evidence for the non‐musical benefits of music listening and instruction is limited. The inherent value of music and music education should not be overlooked by narrowly focusing on cognitive and academic outcomes.  相似文献

Abstract

Current debates highlight the dualistic nature of community sport, which is shaped by both emancipating logics and controlling logics. Critical scholars have warned against the current prioritization of controlling logics over emancipating ones, as this might lead to instrumental approaches in which the vulnerability of young people is managed rather than tackled. However, little research has been conducted on the way in which practitioners perceive and act upon the dominance of social control as a value within community sport. In this article, we report on the findings of a qualitative study into three community sport initiatives in Flanders, Belgium. The data indicate there are small emancipatory moments within the daily practice of community sport. Based on these results, we propose a reconfiguration of the concept of emancipation from being a solid, utopian ideal towards being a search for moments where the dominant logics of social control are momentarily disrupted.  相似文献
