| 摘 要： | 我国《著作权法》对于职务作品权利的归属做出的规定十分详细，但是在实践运用过程中会使人们产生许多疑问。笔者认为首先应当对职务作品做出明确的界定，然后从著作财产权和著作人格权两方面，加强对作者的保护；在此基础上结合当前我国职务作品制度存在的问题，提出了尽快改变现有的职务作品权利归属制度的一些新认识。

| Abstract: | China’s Copyright Law defined clearly the rights of a work created in the course of employment,which would lead to many problems in practice for people.This article holds that it is necessary to define a work created in the course of employment clearly,and then to strengthen the protection of the works from the aspects of property rights and right of personality.The paper put forward some suggestions to improve the current situation of protection for the work created in the course of employment. |
