| 摘 要： | 从刑法理论的角度,研究了竞技体育行为的正当化问题,对正当竞技体育行为在刑法理论体系中的地位进行梳理;归纳并比较各国关于正当竞技体育行为的立法模式;竞技体育行为本质(正当化的根据)上具有社会相当性,是一种社会相当行为;最后提出构成正当化竞技体育行为必须同时具备5方面的条件.

| Abstract: | The author studied the issue of making competitive sports behaviors rightful from the perspective of the theory of criminal law, probed into the status of rightful competitive sports behaviors in the theoretical system of criminal law,and summed up and compared the legislative modes of various countries pertaining to this issue. The author considered that a competitive sports behavior was provided with social correspondence essentially (the criterion of making it rightful),and was a socially corresponding behavior. Finally,the author set forth the conditions in five aspects that must be provided with simultaneously to constitute a rightful competitive sports behavior, hoping to provide a certain standard for judging whether a competitive sports behavior is rightful and determining the boundary between guilty and not guilty in juridical practice. |
