| 摘 要： | 目前我国尚未建立体育禁令制度,无法满足体育纠纷得到司法迅速有效救济的需要,在体育司法救济机制方面设立体育禁令制度势在必行.本文比较了国外相关的禁令制度,检讨了我国现有的禁令制度,对我国确立体育禁令制度的必要性进行分析,并分析了体育禁令一些基本理论问题.在此基础上,本文提出我国体育禁令制度的立法建议,希望所阐述的观点对我国未来的体育禁令制度的制定有些许贡献.

| Abstract: | At present in china, sports ban system has not yet been established which can not meet the need of which sports conflicts can be addressed fast and effectively. Therefore it is imperative under the situation to build sports ban system in the mechanism of sports judicial relief. The paper will review the existing ban system, compare with the foreign relevant systems, analyze the necessity of building sports ban system in China and discriminate the fundamental theory of sports ban system. Based on this, the paper will put forward to the proposal of construction of our sports ban system, hoping that the proposal in issue can make some contributions to the establishment of Chinese future sports ban system. |
