| 摘 要： | 刑事庭前审查是相对于法庭正式审理而言的，是位于检察机关提起公诉之后，法庭正式开庭审理之前的中间程序。作为一种司法审查活动，刑事庭前审查程序对于刑事审判的顺利进行以及对司法资源的优化利用有着重要意义。为此，对现行刑事庭前审查程序现状及存在问题进行分析和比较，从而尝试构建适合中国司法实践的刑事庭前审查程序。

| Abstract: | Criminal examination before opening a court session is opposite of the formal court trial and between post-prosecution and holding a hearing. As one of the judicial examinatorial activities, it makes an analysis and comparison of problems that exist in criminal trial. This paper offers some suggestions of con structing criminal examinatorial procedure before opening a court session with Chinese characteristics. |
