| 摘 要： | 合伙在现代经济活动中起着越来越重要的作用，明确其法律地位具有重要意义。本认为，企业型合伙具备民事主体资格，非企业型合伙则需具备一定条件才能成为民事主体。

| Abstract: | The Partnership plays more and more important roles in modern economic social activity, so it is of great importance to firm its legal position. The paper holds the view that, the partnership between enterprises is qualified as civil subject, while the partnership in other forms should have some necessary conditions so as to become civil subjects. |
