| 摘 要： | 关于当事人举证与仲裁庭查证的关系问题是我国仲裁法学举证责任制度理论研究与实践中的争论的焦点。我国民商事仲裁举证责任的配置应当按照现代民事证据制度的一般法理与民商事仲裁的通行做法 ,结合我国的现实国情 ,正确地划分当事人举证与仲裁庭查证各自的范围并完善相关的保障和约束机制。

| Abstract: | One point at issue in the study and practice as to the burden of proof in the arbitration law is about the relationship between parties producing evidence and the arbitration tribunal investigating and collecting evidence on its own initiative. The distribution of the burden of proof in our civil and commercial arbitration should be conformed to the common legal principle of modern civil proof system and the general practice in civil and commercial arbitration, according to the current condition of our country, and correctly decide the scope between parties producing evidence and the arbitration tribunal investigating and collecting evidence as well as improve related secure and restrain mechanism. |
