| 摘 要： | 离婚损害赔偿制度是我国新增设的一项法律制度,它的确立进一步完善了我国的民事法律体系.由于婚姻法的规定过于简单,<关于适用(中华人民共和国婚姻法)若干问题的解释(一)>(以下称<婚姻法解释一>)的颁布,使离婚损害赔偿制度得到了一定的完善,但其内容仍有缺陷:离婚损害赔偿法定过错情形范围;损害赔偿的范围模糊;请求权主体"无过错力"的规定;把"第三者"排除在过错赔偿的承担义务主体之外;离婚损害赔偿的数额没有明确规定;损害赔偿中无证明标准的规定;离婚损害损害赔偿仅适用于诉讼离婚.本文通过对这些问题的深入探讨,以期对民法典亲属编的制定和离婚损害赔偿制度的进一步完善有所裨益.

| Abstract: | as a new legal system in new marriage law, the divorce damages system improves the civil law
system in china. Its content has still defects thoughhas promulgated. To perfect civil code and system of divorce damages,
the paper discusses these defects deeply and puts forward amendments. |
