| 摘 要： | 当代中国的物权立法、理论争鸣多集中于具体制度的建构、存废。日本民法学者我妻荣早在上世纪30年代完成的《债权在近代法中的优越地位》一书从逻辑、目的价值以及经济社会根基多层次、多角度地分析物权与债权关系的方法值得体味、学习。物权研究与立法应当以人为本,吸收经济社会政治研究的成果,通过合目的、高效率的技术架构在物权的框架内外形成相对稳定的、统一的法律以及法解释体系,把中国的实际物权问题解决好。

| Abstract: | The contemporary legislation practice and the theory argument in China's real right law concentrate on the construction of the concrete system.The Japanese civil law work"the Superior Status of Creditor's rights in Modern Law"was written from the angel of the logic,the goal and value and the economical and social foundation of law multi-levelly analyses relation of real right and the creditor's rights.This method is highly valuable and helpful.The study and legislation in real right law must hold the humanistic value,absorb economical,social and political research achievements,through the highly efficient technical construction according to the goal to form a relatively stable,unified law system and law interpretation system inside and outside the law of real right frame,thus ultimately China's real right problem could be solved. |
