| 摘 要： | 破产是市场经济条件下不可避免的经济现象,也是市场竞争的必然产物。一个健全完善的市场经济法律体系,应当具备一个有效运行的市场主体法律机制,市场交易法律机制和市场退出法律机制。同时作为市场退出法律机制的破产法律制度的完善与否,则衡量了一个国家市场经济的成熟程度。因此新破产法正是为了建立一种公平竞争、优胜劣汰的市场经济机制而拟定的市场主体退出法律规范。

| Abstract: | Bankruptcy is inevitable economic condition of a market economy,as well as the inevitable outcome of market competition.A sound legal system of market economy should have a legal mechanism for the effective functioning of the market players,legal mechanism from the legal market and the market mechanism.Meanwhile,the perfect or not of the bankruptcy law of market withdrawal mechanism measures the mature degree of a national market economy.The new bankruptcy law is the legal norm of market withdrawal drawn up to establish a fair competition,development of the market economy mechanism of survival of the fittest. |
