| 摘 要： | 2004年宪法修正案的第20条和22条将公共利益作为国家对土地和公民合法财产的征收、征用的理由。公共利益既然构成对私权克减的正当理由,那么究竟什么是"公共利益",就引发了学界和实务界的思考。文章从语义分析、界定原则和方法等角度对公共利益的含义进行了分析。

| Abstract: | The item 20 and 22 of Constitution Amendment in 2004 provides public interest as the reason for the government making a requisition of land and imposing private property.As the account of limiting private right,the connotation of public interest attracts academic circles and practical circles.This article analyzes the connotation of public interest by semantic analysis and the principle of the definition. |
