| 摘 要： | 理性传统一直是西方文明中的核心命题,它对整个西方文明产生过深远影响。作为西方文明重要组成部分的法律文明也深受其影响,不仅法律本身是理性的产物,而且一些构成法律制度基础的自然法学与实证主义法学都是理性话语的产物。同样证据制度的形成与演化以及具体运用也都在理性的作用下展开。

| Abstract: | Rationality tradition has been the key proposition in Western civilization,and it has produced far-reaching effects on the whole Western civilization and profoundly affected legal culture as an important part of the Western civilization.Not only is the law itself the product of rationality,but also some of the natural laws and legal positivism that constitute the foundation of legal system are the product of rational discourse.The formation,evolution and specific applications of evidence system are started in the role of rationality likewise. |
