| 摘 要： | 在现代社会,社会募捐作为一种以公益事业和他人利益为目的的行为,随着社会的进步和经济的发展日益增多。但是,爱心捐赠行为在给人们带来爱的同时,也引发了诉讼纠纷。由于法律规范的缺失,不同法院对此类案件往往做出大相径庭的裁判,而学者们的意见同样是众说纷纭。笔者大胆摒弃了以往的惯常思路,认为应当从类型化研究的全新视角出发,对不同募捐类型下捐赠钱物所有权的转移详加分析,这才是解决类似争议的正确路径。

| Abstract: | In modern society,soliciting contributions as a benevolent act for the interests of other people or the public,are increasing with the development of economy and society.However,the kind-hearted donations bring about the care for people who need help as well as lots of litigations.Incompatible legal judgments were made because the judges could not figure out which rules to apply to.Meanwhile,controversial opinions are held by different scholars in theory.The author insists that we should abandon normal thoughts,and brings forward a wholly new research perspective.The research of soliciting contribution classification will go through this article.And the transference of property also differentiate from one another in different types.The author believes only in this way can we find out the appropriate solutions to dispute the soliciting contributions. |
