| 摘 要： | 通过比较研究的方法,结合实际案例,对体育比赛中裁判的法律责任问题进行了分析.旨在探讨在基于恶意和严重过失作出错误裁决的情形下,裁判在承担内部纪律处罚的同时,是否应当承担法律责任.研究认为,在体育运动中,裁判是比赛规则的执行者,对比赛结果具有绝对的决定权,但是,裁判有时也会犯错误,并依照错误的判断作出错误的裁决.一般而言,基于默示条款,参赛者对于比赛的结果也应当予以接受,如果裁判的裁决是基于恶意或严重过失,不仅违反了相关比赛规则的规定,还违反了法律义务.因此,应当对自己的不法行为承担法律责任,包括合同责任、侵权责任、行政责任和刑事责任,以使利害关系人的合法权益得到保护和救济.
