| 摘 要： | 当今世界,各国的诽谤案件日益增多,诉讼解决成本不断增大,且诉讼解决的弊端也日益显现。美国为了更好的解决诽谤案件,减少诽谤纠纷解决成本,平衡言论自由与名誉权保护,从而制定了UCCDA。UCCDA的适用主体与案件范围广泛,能及时、彻底的解决诽谤纠纷,并能减少诉讼成本,对诽谤纠纷的解决具有重大的意义。研究UCCDA的立法及适用情况,为我国诽谤纠纷的解决开辟一条新的思路。
