| 摘 要： | 学校不是未成年学生的监护人,但对未成年学生负有教育、管理、保护的义务。学校对未成学生主要负过错责任,兼负过错推定责任和公平责任。《学生伤害事故处理办法》只能作为判案的参考,且规定有不妥之处。
