小产权房购买者利益保护探析

摘    要:小产权房作为一个社会问题引起关注是在房价高涨、政府调控不力、住房保障措施不到位的背景下产生的。在现有的制度框架下,其因缺乏相关的法律保护,无法进行产权登记,从而其存在和流转受到各方面的质疑和阻碍。由于其本身涉及多方利益主体,故如何正确认识及合理化解各方利益冲突将成为决定小产权房命运的关键。作为小产权房购买者,其自身利益的保护亦应受到更多关注。

Abstract:House with limited property rights arouse people’s growing concern as a social problem with rising house price,ineffective government regulation and inadequate housing safeguard measures.In the existing system framework,the existence and circulation of the house with limited property rights are up against the doubts and obstacles because of the lack of protection of relative laws and being incapable to conduct the registration of property rights.Since house with limited property rights involves multi-stakeholders,it becomes the key to determine its fate that how to understand and rationaliy settle the interests conflict of all parties involved.More attention to should be paid particularly to their own interests’ protection as the buyers of the house with limited property rights,.
