| 摘 要： | 竞技体育作为一个商业化极强的社会环节，必然要与法律发生密切接触。然而现实中人们却容易将其脱离于刑法控制之外，把竞技体育当成是独立的自治区域。从竞技体育的法律地位和刑法问题及成因着手，提出竞技体育刑法价值的概念，以刑法理论为基础，结合犯罪学理论，把竞技体育当中可能的犯罪问题统一纳入到一个刑法系统中进行甄别、分析，进行特殊预防控制和一般预防调整。
