| 摘 要： | 在党和国家推动社会主义文化大发展大繁荣的背景下,从文化向度对体育法治发展的几个问题进行讨论:在体育法治化进程中,阐发由经济、政治发展所决定的从传统法制、人治向现代法治变迁的深刻文化发展动因;结合社会与体育发展的根本取向,揭示体育法治为促进和保障公民体育权利及身心和谐发展的文化意蕴与境界;依据国际和国内的法律渊源,从文化权利的视域解析体育权利的法律属性。

| Abstract: | This paper discusses some issues on the development of legal institution from the dimension of culture under the background of China’s promoting the prosperity of socialist culture.It states the culture development causes which shift from traditional legal institution and rule by man to modern legal institution,determined by economy and politics development.Combined the orientation of society with sport,this paper points out the culture implication of law construction to promote and guarantee the people’s sport rights and the harmonious development of mind and body.Besides,the legal characteristics of sport right has been analyzed from the history of laws home and abroad. |
