| 摘 要： | 社会生活中所形成的利益关系是复杂多样的，然而法典不可能将所有的生活中的利益关系都予以规定，因而在民法理论和实践上就有了法益的存在。民法法益存在的法律因素是有限的制度设计不能保护所有的利益关系。民法法益存在的社会因素是社会之高速发展对民法的利益调整模式提出了新的要求。民法法益的存在具有权利源泉和弥补权利定型化不足之价值。

| Abstract: | Benefit relationships in the social lives are complex and various.However,benefit relationship couldn't be totally formulated by code.Thus,it is certainly that legal benefit of civil law will exist on theory and practice.Judicial element of existence of legal benefit of civil law is that limited institution couldn't protect all benefit relationship.Social element of legal benefit of civil law is that rapid development of society put a new demand on benefit regulation model of civil law.Value of existence of legal benefit of civil law is that it is source of civil right and remedies for defect of type-stability of civil right. |
