| 摘 要： | 《钦定宪法大纲》是一个集限制君权与保障君权于一身的矛盾体,限制君权是其主要方面,君主立法权力受到议会的限制,行政权力受到责任内阁的限制,司法权力受到独立司法机关的限制,君权整体受宪法、法律限制.《钦定宪法大纲》虽限制君权,但其所设计政体与立宪派期望相去甚远,加之表面上对君权保留过多,强调过甚,使得原本就对清政府缺乏信任的立宪派对《钦定宪法大纲》产生误读,以《钦定宪法大纲》为守卫专制之堡垒,而非通往宪政之起点.尽管如此,《钦定宪法大纲》仍成为立宪派推动立宪运动的法理依据,对清末立宪仍具正面效应.

| Abstract: | Constitution outline by the emperor of Qing Dynasty was a contradiction including limiting monarchical power and ensuring monarchical power,where limiting monarchical power was principal.Legislative power of emperor was limited by parliament,while administrative power of emperor was limited by cabinet.Judicial power was limited by independent judicial departments.However,the constitutional advocators still read the outline wrongly,who thought the outline guarded despotic,and wasn’t a beginning of constitutional government,because the form of government of the outline wasn’t what they wanted,and power of the emperor was declared too much.At the same time,the outline still became legal basis of the constitutional advocators promoted constitutional movement,and affected constitutional movement in the late Qing Dynasty positively. |
