| 摘 要： | 传闻证据排除规则作为英美法系证据法的重要组成部分，是其区别于大陆法系证据法的显著特征之一。传闻证据在英美法庭上是不能作为认定案件事实的证据材料，但是其中传闻证据排除规则的例外情形之一“违反利益的陈述”却可以作为例外而具有可采性。本文以《加拿大证据法典》中的两个案例为切入点，探讨“违反利益的陈述”的传闻证据为什么可以被采用的原因，进而说明其适用的理论基础及意义。

| Abstract: | The hearsay evidence rule as an important part of the Common Law System＇s Evidence Act, which is one of the remarkable features different from the Civil Law System＇s Evidence Act. The hearsay evidence cannot be submitted for a case riding in the court of Common Law System. But The Statements Against Interest of hearsay evidence are admissible,which as one of The Exception to The Hearsay Evidence Rule .This article is Based on two eases in EVIDENCE A CANADIAN CASHBOOK to study why The Statements A- gainst Interest of hearsay evidence are admissible.Then explain the theoretical basis and significance of its applying. |
