| 摘 要： | 刑讯逼供这种古老而又野蛮的诉讼手段，历来是我国严令禁止的，修订后的刑法，进一步强化了对刑讯逼供犯罪行为的打击力度，然而，新的刑事诉讼法实施几年来，刑讯逼供仍时有发生。对此，我们应当对刑讯逼供产生的原因进行全面分析，在掌握其实质根源的基础上，找出有效的遏止途径，以保证法治社会司法的公正性和文明性。

| Abstract: | Extorting a confession by torture-ancient and barbarous proceedings,has always been forbidden in our country.The revised criminal law helps us take strong measures against such cnimimal action.However,extorting a confession occurs now and then.So we should give a very comprehensive analysis of criminal action and take effective containment methods in order to ensure civilization and impariality in judicial proceedings. |
