| 摘 要： | 我国政府先后签署了《经济、社会和文化权利国际公约》和《公民权利和政治权利国际公约》,意味着我国政府对公约中条款的认可。两个人权公约与我国宪法之间,既有差异性。又有一致性,因而产生宪法与条约之间的冲突和协调问题。规范和完善我国宪法,实现宪政体制对两个人权公约适用的认同,必将促进我国人权宪政制度的不断发展完善。

| Abstract: | Chinese government successively signing two international pacts: "Economy, Society and Culture Rights" and "Civic Right and Political Right", means the approbation to the clauses in the pacts. However, there exist otherness and consistency between the two human right pacts and Chinese constitution, as result, the problems of confliction and coherence come into being. Whereas we should normalize and perfect our constitution and make it apply with the two pacts, which will promote the development of Chinese human right constitution system. |
