| 摘 要： | 我国2004年宪法修正案中明确规定“国家尊重和保障人权”。和谐社会的构建离不开人权的宪法保障。目前我国宪法的人权保障机制还存在若干不足，这些均与构建和谐社会相悖，需要不断完善。
