| 摘 要： | 证人①拒绝作证是一种权利,英美法系和大陆法系均对此作了法律上的规定,而我国刑事诉讼法对此却未有涉及。但从实践和理论两方面考虑,我国都应设立证人拒证规则。本文从该规则的合理性、中外立法概况以及如何构建这一规则三方面进行了论述,希望能对我国司法实践及《刑事诉讼法》的修订有一定参考价值。

| Abstract: | The witness has the right to refuse testifying,which is stipulated by Common Law Systm and Civil Law System.However,so far as Criminal Procedure Law of the People's Pepublic of China is concerned,which right not is included.Taking the two aspects between theory and practice into consideration,we would set up the statutory regulation of the aforesaid right.This article display the tationality of this regulation,the teneral situation of legislation internal and external and how to ser up this tegulation,three aspects put forward the full treatise.Meanwhile,we hope it is valuable and helpful to the revise of Criminal Procedure Law and Judicature Practice of Our Country. |
