| 摘 要： | 暂予监外执行是我国刑罚执行变更制度的重要内容，检察机关担负着对暂予监外执行实施监督的重任。但在我国司法实践中，检察机关的法律监督基本以“外在式”、“事后式”模式出现，并缺乏强制效力，无法保证监督的实效。在新《刑事诉讼法》、《刑法修正案（八）》施行的背景下，本文提出构建对暂予监外执行的全方位法律监督机制，以期完善检察监督工作机制，促使暂予监外执行工作依法有序开展。

| Abstract: | As the important content of the penalty alteration system, temporary execution outside prison is under supervision of the People＇s Procuratorate. However, the supervision by the People＇s Procuratorate is basically ＂external ＂, ＂after-the-event＂ and lacking a compulsory force, which cannot guarantee the actual effect of supervision. Against the background of the implementation of Criminal Procedure Law of the People＇s Republic of China and Criminal Law Amendment （ eight ）, this article comes up with a more comprehensive supervision mechanism to ensure that the work of temporary execution outside prison can be legaUy and smoothly carried out. |
