| 摘 要： | 绿色建筑合同能源管理模式在实现绿色建筑运营价值方面的优越性已引起业界的高度重视。在分析既有合同能源管理模式的特点和不足基础上,借鉴合同柔性在应对投资、信誉等不确定性风险的补偿调整权利方面的优势,提出基于合同柔性的绿色建筑合同能源管理模式。通过引入合同柔性,重新构建合作框架、设计合同条款,形成关系维度的合同治理;通过刚性与柔性条款的合理配比,形成绿色建筑合同能源管理市场化运作新格局,基于险与收益合理分摊原则实现整体利益最大化。

Study on Green Building Contract Energy Management Model Based on Contract Flexibility |

| Abstract: | The advantages of the green building contract energy management model in realizing the value of green building operations have drawn great attention. Based on the analysis of the characteristics and deficiencies of the existing contract energy management mode, drawing on the flexibility of contract to adjust the right of compensation and adjustment of the risks of uncertainty such as investment and credit, the energy management mode of green contract based on contract flexibility is proposed. Through the introduction of the contractual flexibility to rebuild the cooperation framework, the contractual terms are designed to form the contractual governance of the relational dimension, and the new pattern of marketable operation of the energy management of green building contracts is formed by the rational allocation of the rigid and flexible terms. The principle of reasonable allocation of risks and benefits Maximize the benefits. |
