| 摘 要： | "专利流氓"是市场经济的产物,其存在和发展符合市场竞争规律,美国高智发明(Intellectual Ventures,IV)和Vringo等"专利流氓"公司以及大量专利诉讼案件的出现证明其具有强大的生命力,是专利运营模式的一种创新。运用"鲶鱼效应"理论,从"专利流氓"激励专利运营、盘活专利资源和提高企业创新能力的视角阐述其带来的正面影响。建议我国中小企业在面对"专利流氓"时持辩证和理性的态度,并建议我国立法、司法和行政机关协同合作来制约"专利流氓"滥用专利权利的现象。

Thoughts and Suggestions on Patent Trolls and 'Catfish Effect' |

| Abstract: | Patent Trolls are the product of a market economy, its existence and development in line with market rules of competition. Patent Trolls are bold and innovative business model patents, the United States emerged as an intellectual inventions and patents Vringo such rogue companies and a large number of patent litigation cases, it demonstrated its strong vitality. In this paper, "catfish effect" theory, motivation patent from the patent rogue operators, utilizing patent resources and enhancing innovation capability perspective elaborated positive impact of patent rogue. Finally suggestion of SMEs in the face of rogue should hold the patent dialectical and rational manner, and suggestion of legislative, judicial and administrative authorities collaborate to restrict the abuse of patent rights patent rogue phenomenon. |
